• INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES;
• LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES;
• DAMAGES RESULTING FROM YOUR ACCESS TO OR USE OF, OR INABILITY TO ACCESS OR USE, THE SERVICES;
• DAMAGES RESULTING FROM ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES;
• DAMAGES RESULTING FROM UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT;
• DAMAGES ARISING FROM DELAYS IN DELIVERY OR ORDER FULFILLMENT.

IN NO EVENT SHALL OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES EXCEED THE GREATER OF (A) THE TOTAL AMOUNT PAID BY YOU TO JET'S PIZZA IN THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED UNITED STATES DOLLARS ($100.00).

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN WARRANTIES OR LIABILITY. IN SUCH JURISDICTIONS, OUR LIABILITY SHALL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

The limitations of liability set forth in this section are a fundamental element of the basis of the bargain between you and Jet's Pizza. The Services would not be provided without such limitations.

9. Indemnification

You agree to defend, indemnify, and hold harmless Jet's Pizza and its officers, directors, employees, agents, subsidiaries, affiliates, licensors, and service providers from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, and fees (including reasonable attorneys' fees) arising out of or relating to:

11. Governing Law and Jurisdiction

You hereby irrevocably consent to the personal jurisdiction and venue of such courts and waive any objection to the laying of venue of any such proceeding in such courts.

If you are a consumer in a jurisdiction that provides additional rights or protections under applicable local, state, or federal law, nothing in these Terms shall be construed to limit or waive those rights.

12. Dispute Resolution and Arbitration

12.1 Informal Resolution

We will make reasonable efforts to resolve any dispute through good-faith negotiation within thirty (30) days of receiving notice of the dispute.

12.2 Binding Arbitration

If the parties are unable to resolve a dispute informally, any controversy or claim arising out of or relating to these Terms, or the breach thereof, shall be resolved by binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, which are available at www.adr.org. The arbitration shall be conducted in English. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

The arbitrator shall have authority to award any remedy available in law or equity, but shall not have authority to award punitive damages except where authorized by statute. The arbitrator's authority is limited to claims between you and Jet's Pizza individually.

12.3 Class Action Waiver

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YOU WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION AGAINST JET'S PIZZA. ALL DISPUTES MUST BE BROUGHT INDIVIDUALLY, AND NOT AS PART OF OR ON BEHALF OF ANY CLASS, GROUP, OR COLLECTIVE ACTION.

12.4 Exceptions

Notwithstanding the foregoing, either party may seek emergency injunctive or other equitable relief from a court of competent jurisdiction to prevent irreparable harm pending the outcome of arbitration. Additionally, claims that legally cannot be arbitrated, such as certain consumer protection claims in specific jurisdictions, may be brought in the appropriate court.

12.5 Time Limitation on Claims

Any claim arising out of or related to these Terms or the Services must be brought within one (1) year after the cause of action accrues. Failure to initiate a dispute within this period shall constitute a waiver of all such claims.

13. Term and Termination

In the event of a force majeure event, we will use commercially reasonable efforts to resume normal operations as quickly as possible and will communicate relevant updates to affected customers as practicable.
